Profile
Fiona is a qualified lawyer in Hong Kong and has practiced as a commercial disputes lawyer for over 10 years.
Fiona has extensive experience in advising both individual and corporate clients on contentious matters, with a primary focus on commercial disputes. She handles complex commercial cases involving recovery of debt, enforcement of security, insolvency, fraud and asset tracing, employment / property / probate disputes and arbitration.
Fiona is an Accredited Mediator with Hong Kong Mediation Centre and Hong Kong Mediation Accreditation Association Ltd. She is also an Associate of the Chartered Institute of Arbitrators and a Civil Celebrant of Marriages.
Experience and Key Cases
- Assisted a BVI subsidiary of a PRC state-owned mining enterprise in claiming against a co-shareholder in a joint venture company holding mining resources in Western Australia and its ultimate owner for repayment of a substantial loan of over US$600 million secured by a share charge and opposing subsequent appeals in the Court of First Instance and the Court of Appeal
- Represented a Hong Kong investment fund management company in supporting a winding-up petition presented by a Cayman Islands investment management company against a Bermuda investment holding company listed on the Main Board in respect of a debt of over HK$315 million in connection with convertible notes issued pursuant to a subscription agreement
- Assisted a US law firm in tracing monies stolen by fraud by obtaining injunction and disclosure orders, defending an application and a subsequent appeal for setting aside default judgment, intervening in garnishee applications from competing claimants and participating in interpleader proceedings taken out by a bank
- Defended 2 brothers in an action involving over 40 parties brought by a Cayman Islands financial planning company and its 2 subsidiaries in relation to the placement of shares and a circular financing arrangement and other related actions in Hong Kong and BVI
- Commenced proceedings on behalf of the owner of a multi-million dollar lost diamond against a fraudster and a leading security transportation and logistics service provider to recover the diamond or its equivalent value
- Defended the executor of an estate and his company and daughter from a claim made by a bank as special trustee of the estate for breach of trust, dishonest assistance and knowing receipt
- Commenced arbitration proceedings on behalf of an Indian technology company against a Hong Kong telecommunications company in the Singapore International Arbitration Centre in relation to misrepresentations or negligent misstatements and unreasonable conduct of the telecommunications company in respect of a digital transformation framework procurement agreement
- Defended a Hong Kong listed company and its subsidiary from a claim made by a former managing director of a subsidiary company for payments raised under his employment contract in the Labour Tribunal and the High Court and counterclaimed for breach of duties of fidelity and good faith and return of payments wrongfully received by the former employee
- Commenced proceedings on behalf of 2 Hong Kong doll manufacturing companies against their former employee for misappropriation of funds, destruction of information relating to the business and removal of confidential data
- Advised various corporations and individuals on termination of employment, statutory leave under the Employment Ordinance, the abolition of the mandatory provident fund offsetting arrangement, employment issues arising from due diligence, staff handbook and sexual harassment complaints
- Opposed a claim made by a BVI land owner against the incorporated owners of a residential building in Hong Kong for an alleged easement over a road and an injunction to preserve the reasonable enjoyment of the road
- Defended the owner of a series of shops in a building from a claim made by the incorporated owners of the building for recovery of a portion of the shops previously used as a common corridor
- Assisted the administratrix of the estate of a deceased in claiming title and interest in a residential property jointly owned by the deceased and his son on the basis of common intention constructive trust and estoppel
- Recovered outstanding sums due under tenancy agreements and/or vacant possession of property from tenants for a major Hong Kong property developer
- Procured rectification of breach of deed of mutual covenant by property owners for established Hong Kong property management companies
